Batman War Games Download

I just got a new Xbox 360 elite and is telling me that it is unable to read disk.?
I bought a Xbox 360 Elite for my nephews for Xmas, they have only been using it since then and it is having problems.
I got them Gears of War 2 and the game keep stopping and saying unable to read disk. The other games the Xbox came with Batman Lego and Real do not have this problem and every Demo they have downloaded works fine as well.
The game is also brand new, so it is a problem with the game or with the Xbox? I keep going to xbox site but their solutions do not sole the problem, should I return the Xbox or the game?
I have no way of testing the game somewhere else.
Try cleaning the Gears of War 2 disk. That will usually fix the problem. The slightest smug or scratch can sometimes set of the disk read error that you are getting. If you tried all of the troubleshooting tips on xbox.com then the problem is most likely with the disk since their solutions are normally hardware fixes. Most retailers will allow you to exchange a game for the same one if you are having problems with it and still have the receipt. It really sounds like a problem with the disk if other disks are working properly. If you bought the game from a specialty store like Gamestop, Game Crazy, etc. they will usually check the disk for you to make sure that is the problem.
